Terms & Conditions By using www.gearfortech.com., you automatically submit yourself to its policies, terms, and conditions set forth. In submitting an order for products or services you indicate your acceptance of and agreement to be bound by the Shipping & Policy and terms & conditions set forth on our website. If for any reason you do not agree to any of these Terms & Conditions, please stop from any further usage of www.gearfortech.com. Please note that www.gearfortech.com reserves the right to take legal action when the customer violates the terms and conditions of the sales. Products: All electronic equipments DO NOT carry any manufactory warranty unless otherwise stated. It is not the responsibility of www.gearfortech.com to carry out the warranty. If there are issues after the first seven days, it is the customers responsibility to contact the manufacturer for repair. Products carry a seven days limited warranty by www.gearfortech.com The limited warranty covers the following faults described below. PLEASE BE NOTED THAT WARRANTY IS NOT TRANSFERABLE . If a product is defective doesnt include firmware problem within the first seven days from the receiving date, www.gearfortech.com will repair or replace the product, provided that the customer return the product in a brand new condition and contains all materials that were in the package. www.gearfortech.com is the sole responsible to declare on the condition of the product. Past seven days upon receiving product, if the client does not report DOA or malfunction (doesnt include firmware problem), www.gearfortech.com is not responsible for repair or replacement of the product. What is DOA? Dead on Arrival (DOA) implies that the product either cannot be turned on or be ready in use after taking out from the box. Buyer must pay for all the shipping cost. In the event that a replacement cannot be made due to product availability or any other reasons, www.gearfortech.com will repair the product for the buyer. A repair order may take up to 30 business days starting from the day when www.gearfortech.com receives the defective unit (doesnt include firmware problem). www.gearfortech.com has the right to make the final decision on whether a replacement or a repair process should be issued under any circumstances or situation. No return will be accepted if you fail to present a proof of purchase and having spoken to a representative for RMA number. Customer is solely responsible for fees that might incur (i.e. duty fee, shipping, return freight...) from shipping returned products to www.gearfortech.com . Customer agrees to use only reputable carriers capable of providing proof of delivery and insurance for the entire value of the shipment. Customer agrees to bear all shipping charges and all risk of loss for the return product during shipment. Customer agrees that all returned products will be 100% complete, in re-saleable Brand New condition, and will include the original packaging material, manuals, and other accessories provided by the manufacturer. If any components of the returned products are missing, www.gearfortech.com has the right to reject the returned product or might charge additional fees. IMPORTANT NOTICE: Please note that products that carry Rogers Logo, once returned for repair, Rogers will simlock the phone back to them. Customer will be responsible to pay for the unlocking fee should this incur. NOTE: All cables are not covered by warranty. We will only replace a new cable if you have notifed us within 24 hours upon received. Please note that if for any reasons your payment is delayed, being chargeback, unaccepted and that you have received the product from us, www.gearfortech.com (Asiatic Treasures Trading) reserves the right to charge a monthly 2% to total amount of transaction until payment has been recovered or received in full. By submitting a payment, you automatically agree to comply with our terms and conditions governing our website. Unlocking Credit www.gearfortech.com reserve the right not to issue any refund to any customer(s) after the sale. If you claim that the Unlocking Credit doesnt work, you will have to send us your phone to prove that the Credit did not unlock your phone. Customer(s) agree(s) to pay for all the shipping cost during this process. Network Network Operations and some features are network dependent. Please note that the MMS, SMS and many others related services are dependent on the network as well as the compatibility of the devices used and the content formats supported. Please check the availability of MMS, SMS, GPRS, WAP, and Internet services with your network operator and/or service provider. Buyers are responsible for ensuring this items compatibility with their network operator / service provider. www.gearfortech.com does not respond for any network dependent features and firmware related issue. It is also the buyers responsibility to check whether the phone features are compatible with their computer (i.e. synchronization, Microsoft outlook...). www.gearfortech.com is in no way responsible if these features are not compatible. Limitation of Liability - In no event shall www.gearfortech.com or any of its subsidiaries or affiliates be liable for any indirect, special, incidental or consequential damages including but not limited to loss of use, loss of data, loss of business or profits. - The following restrictions on liability shall not apply to damage which occurs as a result of intentional acts or gross negligence or damage to life, body or health. Pricing We reserve the right to change prices without prior notice as the markets fluctuates often. We try to update our prices daily but occasionally, errors might occur and www.gearfortech.com is not liable for any differences in pricing. If an order is placed for an item with an erroneous price, and that price is less than the cost price of the item, we reserve the right to offer to complete the transaction at cost price or the opportunity for the customer to cancel the order without penalty or 25% restocking fee. www.gearfortech.com reserves the right of the quoted price for out-of-stock pre-order products until arrival item. Pre-order or out-of-stock orders will remain lawfully in place for a period of 90 days. When placing a pre-order with us, you agree to this 90 days duration and understand that your deposit is unmovable or refundable. www.gearfortech.com will not cancel any pre-orders except under certain situations, i.e. manufacturers major delay announcement. If that is the case, we will issue a refund. However, if the customer decides not to complete the transaction for any reasons, www.gearfortech.com reserves the right not to issue a refund for the deposit. We reserve the right to decline any order for any reason. These terms are governed by the laws of Canada and any disputes will be decided only by the courts of Canada.
